Any use in violation of these limits shall constitute a violation of the terms of this license. Absolutely no framing of our site is permitted.

Pro Affiliate is a member who joins our Affiliate Program and makes a purchase of any products and or services from any participating Snazzy Promotions Limited domains or through JV Product Launcher as long as that domain or product is currently offered and administered by JV Product Launcher.

We reserve the right to offer JV Partner Affiliate Memberships to any member who joins our Affiliate Program

JV Partner Affiliate Memberships are awarded solely at JV Product Launcher discretion and not becuase of any amount of purchases made.

Any and all commissions payable or payment schemes previously listed individually or accumatively for or on any Snazzy Promotions Limited domain is hereby as of this date 20th July 2005, revoked in their entirety and no longer enforceable.

All commissions payable through Snazzy Promotions.com Affiliate Center, for the domains completely transfered over will be on the following basis.

First Paid means, you as the Affiliate are paid first to either your Paypal account from the successful completion of a sale generated through the JV Product Launcher.

The commissions set are as follows:
Free Affiliates will receive 25% of the listed price for that particular sale - First Paid.
Pro Affiliates will receive 50% of the listed price for that particular sale - First Paid.

These commissions may increase or decrease depending on the nature of the sale and the offer being made by Snazzy Promotions.com Affiliate Center at the time of the release of the product and or sale.

Any commissions paid directly to you on a successful completion of a sale shall be treated as full and final remuneration for that particular sale unless it is a monthly subscription.

Any refund requests for any product or service provided by or through the JV Product Launcher will be the responsibilty of the Affiliate for and to the full amount received as a First Paid commission.

Neither Snazzy Promotions Limited or JV Product Launcher will accept or be held accountable for any portion of a refund that was First Paid directly to an Affiliate.

It is your responsiblity to ensure you comply with any such requests in an ethical and business like manner.

As an Affiliate of JV Product Launcher, you are granted a non exclusive license to promote your Affiliate URL's, for the sole purpose of advertising SPL's commercial software and freeware software and monthly subscriptions. You are expressly forbidden to imply, make suggestions or promote in any such way or manner, that leads people to believe you are a part owner, employee, staff or in any other way connected with being a Snazzy Promotions Limited officer, official, employee or owner. Any violations of this will be met with swift legal action.

As an Affiliate of the SPL Affiliate Center, you DO NOT have or will ever gain an automatic Resellers and Distribution License to any of our products, existing or future releases.

There may from time to time be exceptions where Snazzy Promotions Limited with offer for a limited period, a limited Resellers and Distribution License on a certain product.

This License will and only ever be issued to the purchaser of said Resellers and Distribution License, and does not authorize the purchaser to pass, give, grant or in anyway shape or form, authorize the purchaser to on sell, give, grant, gift, or passon said Resellers and Distribution License.

Be aware that any complaint of SPAM against an affiliate means instant termination without recourse and any all commissions/ referrals fee's now or gained in the future will be forfeited forthwith. NO DEBATE OR DISCUSSION WILL BE ENTERED INTO. We have already suffered by losing 2 hosting accounts due to Affiliates SPAM. We are not about to lose anymore.

As an Affiliate of JV Product Launcher we offer no guarantee's, nor warranties expressed or implied that you will ever make any commissions or referral fee's by promoting JV Product Launcher products or services from your Affiliate URL(s).

Any Affiliate changing there referral links so as to purchase from themselves will have that commission/ referral fee rescinded and non payable.

SPL Affiliate Center DOES NOT CONDONE NOR WILL SPL ABIDE BY AFFILIATES CHEATING THEIR REFERRER OF COMMISSIONS BY CHANGING OR INTERFERRING WITH THE COOKIES Or ID's USED AS AND FOR THE PURPOSES OF TRACKING SALES AND REFERRERS COMMISSIONS.

To make it even simpler for you to understand any purchases from your own affiliate link or by setting up a second affiliate username in order to deceive Snazzy Promotions Limited and JV Product Launcher and the originating Referrer of the commission payable, so as you benefit by receiving the commissions/referral fee payable on such a purchase, will simply not be paid.

Furthermore if and when such activity has been discovered all usernames belonging to and or traced back to an Affiliate will be deleted and your Affiliation with Snazzy Promotions Limited and JV Product Launcher will cease with any and all commissions/referral fee's due past, present or in the future will be forfeited without recourse.

Masking of Affiliate URL's or cloaking of Affiliate URL's in order to deceive a user from knowing the actual content of the website prior to clicking on any such link, is strictly forbidden

Any Affiliate that fails to comply will have their Affiliate Membership Terminated without recourse to commissions payable or future payable.

Snazzy Promotions Limited or JV Product Launcher at all times remain and retain full and exclusive Intellectual and copyright to any and all of it's software products and or services, including and notwithstanding, any and all commercial, freeware and scripting programs as displayed on their web site in its entirety. This includes any and all commercial, freeware and scripts existing and future releases.

Snazzy Promotions Limited or JV Product Launcher may at anytime now or in the future, release a similar product under a new name and offer this new product as a commercial, freeware or scripting program without jeopardy or recourse from any and all purchasers of a Resellers and Distribution License for a similar or particular software program, whether commercial, freeware or a scripting program.

Snazzy Promotions Limited or JV Product Launcher can and will without prejudice or recourse release a similar commercial product as a freeware product, without liability to claims of loss of income or potential sales, due to the release of any or similar commercial software program being released as a freeware.

Should you purchase a Resellers and Distribution License(s), it is your responsibility to review these terms and accept them in their entirety or forgo proceeding to purchase said Resellers and Distribution License(s). Failure to read these terms and conditions does not make Snazzy Promotions Limited or JV Product Launcher liable for any claims of loss of earnings, income or potential sales from your error and omission to acquaint yourself with the above said terms.

"Snazzy Promotions Limited or JV Product Launcher" reserves the sole and exclusive right and discretion to cancel service at any time to anyone for any reason. We enforce this policy to ensure a professional environment for the users of our system.
"Snazzy Promotions Limited or JV Product Launcher" also reserves the right to cancel any order, for any reason whatsoever and refund the purchaser through the same medium in which they purchased.

"Snazzy Promotions Limited or JV Product Launcher" reserves the right to terminate any Member, Safe List Admin or Subscriber for Spamming. (AKA UNSOLICITED EMAIL). As a client you have the right to seek a total 100% refund on the actual amount paid directly to JV Product Launcher paid through Snazzy Promotions Limited on any purchase(s) made within 30 days of purchase based on your dissatisfaction of product.

Any refund requests for any product or service provided by or through JV Product Launcher will be the responsibilty of the Affiliate for and to the full amount received as a First Paid commission.

Neither JV Product Launcher or Snazzy Promotions Limited or any Snazzy Promotions Limited officer, owner or associate will not be held responsible or accountable for the repayment of any portion of a refund that was First Paid directly to an Affiliate.

It is your responsiblity to ensure you make any such requests directly with the Affiliate concerned that received the payment as their portion of the sale price deemed as First Paid commission.

Should Snazzy Promotions Limited or any officer of Snazzy Promotions Limited negotiate on your behalf with the said Affiliate does not construe or deem this action as being or accepting any liability for the non-refund from the said Affiliate.

However, "Snazzy Promotions Limited domain(s) or JV Product Launcher" reserves the right to refuse a refund in it's sole discretion, without legal recourse or representation, if such a request is made after 30 days from date of purchase which is always kept on file.

Should a fraudulent purchase be made using your CC or any other payment service it is your sole responsibility to seek a refund or recompense from your provider.

"Snazzy Promotions Limited domain(s) or JV Product Launcher" will not make refunds available without satisfactory proof that a fraudulent transaction has occurred. In other words, you simply saying or implying their was a fraudulent charge is not sufficient in order to procure a refund.

THE SERVICES PROVIDED TO YOU WILL BE DEEMED AS BEING SUPPLIED FROM WHANGAREI, NEW ZEALAND AND THE JURISDICTION OF THE LAW SHALL BE DEEMED THAT AS OF THE COMMON LAW OF THE DISTRICT HIGH COURT OF WHANGAREI NEW ZEALAND.

YOU AGREE BY BECOMING A "CLIENT", "Member", "Subscriber" OR "Surfer" OF THE SERVICES PROVIDED BY SPL THAT ANY CLAIMS ARISING FROM SUCH USUAGE WILL BE GOVERNED BY THE LAW OF THE DISTRICT HIGH COURT OF WHANGAREI NEW ZEALAND AND ANY JURISDICTION OF ANY OTHER COUNTRY, STATE, OR TERRITORY WILL BE SUPERCEDED AND VOID AND STRICTLY DEALT WITH THROUGHT THE COMMON LAW OF THE DISTRICT HIGH COURT OF WHANGAREI NEW ZEALAND AND WILL ONLY BE TO THE AMOUNT OF THE ACTUAL SOFTWARE PURCHASED PRICE PAID AMOUNT.

This Agreement is governed by the laws of the District High Court Of Whangarei, New Zealand, without regard to principles of conflict of laws. To the extent you have in any manner violated or threatened to violate "Snazzy Promotions Limited or JV Product Launcher " and/or its affiliates' intellectual property rights, "Snazzy Promotions Limited or JV Product Launcher " and/or its affiliates may seek injunctive or other appropriate relief in the District High Court Of Whangarei, New Zealand, and you consent to exclusive jurisdiction and venue in such courts. Any other disputes will be resolved as follows: If a dispute arises under this agreement, we agree to first try to resolve it with the help of a mutually agreed-upon mediator in the following location: Whangarei, New Zealand. Any costs and fees other than attorney fees associated with the mediation will be shared equally by each of us. If it proves impossible to arrive at a mutually satisfactory solution through mediation, we agree to submit the dispute to binding arbitration at the following location: Whangarei, New Zealand, under the rules of the New Zealand Arbitration Association. Judgment upon the award rendered by the arbitration may be entered in any court with jurisdiction to do so.
